Please read these Terms and Conditions carefully before using the https://www.examfitter.com website (the “Service”) operated by ExamFitter (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Accounts and Registration

1.1. To access certain features of the Service, you may be required to create an account. You must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

1.2. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

1.3. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

1.4. You may not use as a username the name of another person or entity that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization.

2. Intellectual Property Rights

2.1. The Service and its original content, including but not limited to revision notes, quizzes, worksheets, text, graphics, logos, and software (collectively, “Content”), are and will remain the exclusive property of ExamFitter and its licensors. The Content is protected by copyright, trademark, and other laws of Pakistan and foreign countries.

2.2. License to You: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its Content for your personal, non-commercial, educational purposes only, in accordance with these Terms.

2.3. Third-Party Materials: Past examination papers, mark schemes, and other resources originating from Cambridge Assessment International Education (CAIE) remain the intellectual property of CAIE. These materials are provided on our Service for educational and practice purposes only. ExamFitter does not claim ownership of these specific materials.

2.4. Restrictions: You are expressly prohibited from: a) Selling, sublicensing, or otherwise commercializing any Service material. b) Publicly performing or showing any Service material. c) Reproducing, distributing, modifying, or creating derivative works from our original Content without our express written permission. d) Using this Service in any way that is, or may be, damaging to this Service or its users.

3. Permitted and Prohibited Use

3.1. You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Service.

3.2. Prohibited behavior includes, but is not limited to: a) Using automated systems or software to extract data from the Service (“screen scraping”). b) Sharing your account login credentials with any other individual. c) Attempting to circumvent any security features of the Service. d) Uploading or transmitting any form of malicious code, viruses, or any other material which is technologically harmful.

4. Subscriptions and Payments

(This section will apply if and when ExamFitter introduces premium paid services.)

4.1. Certain parts of the Service may be billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”).

4.2. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or ExamFitter cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting customer support.

4.3. ExamFitter may, at its sole discretion, modify the Subscription fees at any time. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

5. Disclaimer of Warranties

5.1. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. ExamFitter makes no express or implied representations or warranties of any kind related to this Service or the materials contained on this Service.

5.2. We do not warrant that: a) The Service will function uninterrupted, secure, or available at any particular time or location. b) Any errors or defects in the content will be corrected. c) The Service is free of viruses or other harmful components. d) The results of using the Service will meet your requirements or guarantee any specific academic outcome. The resources provided are study aids, and individual success is dependent on personal effort and other factors.

6. Limitation of Liability

In no event shall ExamFitter, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

7. Indemnification

You agree to defend, indemnify, and hold harmless ExamFitter and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Islamabad.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect by posting the updated terms on this page. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
